Please read these Terms of Service carefully before using ForeverLight. By using the platform, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using ForeverLight (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, including visitors, registered users, and contributors.

2. Description of Service

ForeverLight provides a digital memorial platform that allows users to create, manage, and share online memorials for deceased individuals. The Service includes features such as profile creation, photo and video uploads, tributes and comments, QR code generation and linking, and privacy controls. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

3. Account Registration

To use certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account. You must be at least 16 years of age to create an account.

4. User Content

You retain ownership of all content you upload to ForeverLight ("User Content"). By uploading User Content, you grant ForeverLight a non-exclusive, worldwide, royalty-free licence to host, store, display, and distribute the content solely for the purpose of operating and improving the Service. You are solely responsible for your User Content. You represent and warrant that: (a) you own or have the necessary rights to the content you upload; (b) your content does not violate any third-party rights; and (c) your content complies with these Terms and all applicable laws.

5. Content Standards

You agree not to upload or share content that: (a) is sexually explicit, pornographic, or contains nudity; (b) depicts or promotes violence, self-harm, or harm to others; (c) is defamatory, harassing, hateful, or discriminatory; (d) infringes on any intellectual property rights; (e) contains malware, spam, or deceptive material; (f) violates any applicable law or regulation; (g) contains alcohol, drug use, or other content we deem inappropriate for a memorial platform. We use automated and manual content moderation. Content that violates these standards will be removed and may result in account suspension or termination.

6. Memorial Content

Memorials are created to honour deceased individuals. By creating a memorial, you confirm that: (a) the person memorialised is deceased; (b) you have the right to create a memorial on their behalf; and (c) you will not create memorials for living persons without their explicit consent. We reserve the right to remove memorials that we determine are created inappropriately, at our sole discretion.

7. Privacy and Data

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

8. Intellectual Property

The ForeverLight platform, including its software, design, logos, trademarks, and all content created by ForeverLight, is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of our platform or content without our express written permission. The ForeverLight name and logo are trademarks of ForeverLight. You may not use our trademarks without our prior written consent.

9. Prohibited Activities

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorised access to any part of the Service; (c) interfere with or disrupt the integrity or performance of the Service; (d) scrape, crawl, or use automated means to collect data from the Service; (e) impersonate any person or entity; (f) engage in any activity that could harm ForeverLight or its users; (g) use the Service to send unsolicited communications; (h) attempt to reverse engineer any part of the Service.

10. Subscription and Payments

Some features of ForeverLight require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by law. We reserve the right to change subscription pricing with 30 days' notice. Failure to pay may result in suspension of premium features.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, FOREVERLIGHT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FOREVERLIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless ForeverLight and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases. Memorial content may be retained for a period following account deletion per our data retention policy.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through a prominent notice on our platform. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
